1. Acceptance of Terms

By downloading, installing, accessing, or using WINK VPN ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Service.

These Terms constitute a legally binding agreement between you ("User", "you") and WINK VPN ("we", "us", "our"). Please read them carefully before using the Service.

2. Description of Service

WINK VPN provides virtual private network (VPN) services designed to offer secure and private internet browsing. We offer two tiers of service:

• Free Tier: Ad-supported VPN access with basic features, standard server speeds, and limited server locations.
• Premium Tier: Paid subscription offering an ad-free experience, access to high-speed premium servers, all server locations, unlimited bandwidth, and priority support.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

When creating an account with WINK VPN, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

4. Acceptable Use

You agree NOT to use WINK VPN to:

• Engage in any illegal or unlawful activities in your jurisdiction
• Distribute malware, viruses, trojans, or any other harmful software
• Attempt to breach, circumvent, or test the security of other networks or systems
• Engage in copyright infringement or illegal distribution of copyrighted material
• Send spam, phishing emails, or unsolicited bulk communications
• Attempt to reverse engineer, decompile, disassemble, or modify the WINK VPN application
• Share, sell, or transfer your account credentials to unauthorized individuals
• Harass, abuse, or harm other users or third parties
• Circumvent bandwidth limitations or fair usage policies

5. Premium Subscription

WINK VPN Premium offers enhanced features through a paid subscription. By subscribing, you agree to the following terms:

• Payment Processing: All payments are securely processed through Google Play. WINK VPN does not directly handle or store your payment information.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time through Google Play Store settings. Your premium access will remain active until the end of the current billing period.
• Refunds: Refund requests are subject to Google Play's refund policy.
• Premium Features: Ad-free experience, access to high-speed premium servers, all global server locations, unlimited bandwidth, and priority customer support.

6. Intellectual Property

WINK VPN, including its name, logo, tagline ("Beyond Boundaries"), visual design, source code, graphics, UI/UX design, and all associated content, are the exclusive intellectual property of WINK VPN and are protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the WINK VPN application for its intended purpose. You may not:

• Copy, reproduce, or distribute the application or its components
• Modify, adapt, or create derivative works
• Use our branding, logos, or trademarks without written permission
• Remove any copyright or proprietary notices

7. Privacy

Your privacy is critically important to us. Our handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy highlights:

• We maintain a strict no-log policy
• All traffic is encrypted with AES-256-GCM
• We do not sell your data to third parties
• You can request deletion of your data at any time

8. Disclaimers

Service Provided "As Is": WINK VPN is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Service: We do not guarantee that the Service will be uninterrupted, error-free, or completely secure at all times. Server maintenance, network issues, and force majeure events may affect availability.

Third-Party Content: We are not responsible for any third-party content, websites, or services accessed through our VPN. Users access such content at their own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, WINK VPN, its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Service interruptions or downtime
• Unauthorized access to your transmissions or data
• Any third-party conduct on the Service

In no event shall our total liability exceed the amount paid by you to WINK VPN in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless WINK VPN and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

11. Termination

By Us: We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

By You: You may terminate your account at any time by:

• Deleting your account through the app (Settings, Account, Delete Account)
• Submitting a data deletion request
• Cancelling any active subscriptions through Google Play

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the governing jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Provide notice through the app or via email
• Where required by law, seek your consent before changes take effect

Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you should discontinue use of the Service.
